This really is too funny.  Microsoft is now attempting to nullify a
patent by referring to public standards from IEEE, even though
Microsoft has tried to patent "standards" from other organizations,
including IETF, IEEE, Posix, X/Open, and of course, Open Source, as
their own "original" software.

This is why the patent office didn't want to get into the job of
patenting "ideas" or "algorythms" in the first place.  Under the new
law, all you have to do is couple an algorythm (device) with an idea
(claim)  and you can get a patent - maybe - if you have lots of time
and money - and if someone else doesn't nullify your application - or
nullify your patent with prior art.

There are thousands of patents recently which are more "Archeology"
than "Invention".
I just find it very humerous that Microsoft is fighting tooth and nail
to protect it's own (open Source?) implementation of technology which
is 99.9% IETF/IEEE/ACM/ISO based, but then wants the courts to protect
them from other companies who try to do the same thing.

Obviously, this one is getting settled out of court, but my guess is
that there will be some preliminary rulings that will have the Judge
giving Microsoft yet another hairy eyeball.
