Seems to me, there's an easy way round that.

Distribute the LiveCD buildsystem (isolinux et al) in a zip file, and
include both Windows and Linux scripts to rebuild (like SLAX). All the
users' need to do then, is download the binary driver and run the script
and voilà ... one XGL Live CD.
