Setting Standards
,----[ Quote ]
| For if anything other than royalty-free terms are adopted, open source is
| effectively locked out – something that Microsoft knows full well, which is
| why it has pushed for “Reasonable and non-discriminatory licensing” (RAND).
| At first sight, this appears fair enough – after all, if it is
| non-discriminatory, what's not to like?
|
| But the point is that it is not possible for free software programs to
| support even nominal licensing fees, since the unlimited, unchecked
| distribution of code makes it impossible to monitor how much should be paid.

Rambus Redux: The FTC Tries One Last Time (and so do I)
,----[ Quote ]
| This has made its stockholders particularly partisan, as its stock has risen
| and fallen in synchrony with its fortunes in court, and its detractors
| particularly irate, because they view Rambus not only as a patent troll, but
| also as one that has gamed the standards development process during the
| creation of a universally adopted SDRAM memory standard. Hundreds of
| millions, and perhaps billions, of dollars of royalties are at stake.

European Patent Office staff to demonstrate for reforms
,----[ Quote ]
| The international Staff Union of the European Patent Office (SUEPO) has
| called on the staff of the office to strike on Thursday 18th of September,
| and to demonstrate in Brussels for a reform of its supervisory board. The
| strike and demonstration are timed to coincide with meeting in the Belgian
| capital of the executive of the patent office, under its president Alison
| Brimelow, to seek approaches to a "strategic renovation". The employee
| representatives expect around 300 staff members from the patent offices in
| Munich, Berlin, The Hague and Vienna to attend the protest rally.

EPO examiners do not trust Brimelow for her quality reforms
,----[ Quote ]
| According to an EPO internal staff survey of June 2008, only 9% of the EPO
| examiners believes that "Brimelow and the Vice-Presidents actively promote
| patent quality". Brimelow is progressing, since Alain Pompidou, the former
| President, had a trust of only 7%.

Patents – Do you really need them?
,----[ Quote ]
| In the last Venture Capital Journal, Thomas Klein from Wilson Sonsini wrote a
| great article (Actually link doesn't work – this article requires
| subscription) about the diminishing value of patents for early stage
| technology companies. In the short article he quoted 5 recent court decisions
| that have created limited the value of patents. I will not repeat all the 5
| cases that he quotes, but his overall verdict is clear: Leveraging patents in
| the courtroom is becoming harder and harder.
