Is there an OEM contract running around that stipulates such?
Color me curious.

Is that contract legal?  Color me even more curious.

Of course one of the problems (opportunities?) with Linux
is that it and Windows support different hardware sets.
Granted, there's a very large amount of overlap, but we
do know certain Creative Labs cards have no Linux drivers,
for example.  (I am not sure if the reverse is true, though
at one point Linux led Windows handily in x64 support,
but that's no longer an issue.)
