UK Liberal Democrats rise against Net blocking

,----[ Quote ]
| Members of the UK Liberal Democrat party are
| angry that one of their own put through an
| onerous web blocking amendment to the
| Digital Economy Bill. This dangerous
| amendment provides for web blocking by
| courts, in addition to 3-strikes
| provisions. It could usher in a bi-
| directional blocking of the UK Internet.

BT's boss comes out fighting

,----[ Quote ]
| What Mr Livingston had to say will not make
| comfortable reading for Labour, the
| Conservatives or the Liberal Democrats. On
| the bill, he was concerned that people were
| going to have their right to fair hearing in
| court taken away - that his customers could
| end up having their internet accounts
| suspended for alleged illegal file-sharing
| without due process. He proposed an
| alternative - a system of fines much like
| those imposed on speeding motorists, with
| the accused then choosing either to pay up
| or have their day in court.
|
| [...]
|
| BT has appeared content in recent months to
| let Charles Dunstone of Carphone Warehouse
| grab the limelight when it comes to telling
| politicians what to think about technology
| policy. Now it seems Ian Livingston wants to
| make sure his voice is heard.

A wrecking amendment ?

,----[ Quote ]
| For the past few months the Digital Economy
| Bill (DEB) has been quietly making its way
| through the House of Lords. As is the way of
| these things, large numbers of amendments
| have been proposed, their lordships have had
| a series of mini-debates on each set of
| issues, and the Government have been busily
| amending the Bill in an attempt to fix all
| the things that they didnât think through
| properly.

Digital Economy Bill is disaster for digital economy

,----[ Quote ]
| As well as ORG's own campaign, Liberty and
| Consumer Focus have expressed concern about
| the Bill. Universities and libraries have
| expressed outrage that they are, somewhat
| perversely, covered by the Bill's proposals
| much as householders are. Internet giants
| like Google, Facebook and BT have banded
| together to object to to the Bill, as have
| small businesses.

Three Strikes Rule: Sleeping for Seven Months

,----[ Quote ]
| Last month I requested the South Korean
| government to disclose information on the
| three strikes rule that came into effect on
| July 23, 2009. Surprisingly there was no
| single case in which the rule has been
| actually applied or considered to be
| applied.

Anti-Piracy Scheme âA Scam & Legal Blackmailâ Say UK Lords

,----[ Quote ]
| Several UK Lords have criticized the
| practices of law firms that send out
| warning letters to alleged copyright
| infringers demanding big payments. These
| schemes have been labeled a scam, and the
| lawyers operating them accused of
| âharassment, bullying and intrusionâ and
| âlegal blackmailâ in the House of Lords.

Geist: Three strikes and youâre out system draws cries of foul from governments

,----[ Quote ]
| Canadian officials travel to Guadalajara,
| Mexico this week to resume negotiations on
| the still-secret Anti-Counterfeiting Trade
| Agreement. The discussion is likely to
| turn to the prospect of supporting three
| strikes and youâre out systems that could
| result in thousands of people losing
| access to the Internet based on three
| allegations of copyright infringement.
| Leaked ACTA documents indicate that
| encouraging the adoption of three-strikes
| - often euphemistically described as
| âgraduated responseâ for the way Internet
| providers gradually send increasingly
| threatening warnings to subscribers - has
| been proposed for possible inclusion in
| the treaty.

ACTA Talks in Mexico to Address Transparency Concerns

,----[ Quote ]
| Secretive international talks about how to
| curb counterfeiting and Internet piracy
| are under way in Mexico this week. But
| instead of focusing on the subject at
| hand, negotiators will spend much of their
| time discussing transparency, or rather
| the lack of it in the whole process.

For the Love of Culture

,----[ Quote ]
| Except of course for those with a devoted
| heir, such as Grace Guggenheim. She was
| not willing to accept defeat. Instead she
| set herself the extraordinary task of
| clearing all of the rights necessary to
| permit her fatherâs films to be shown.
| Eight years later, she is largely done.
| About ten major works remain. Just last
| year, her fatherâs most famous
| documentary--Robert Kennedy Remembered,
| made in 1968 in the two months between
| Kennedyâs assassination and the Democratic
| National Convention, and broadcast only
| once--was cleared for DVD release through
| the Robert F. Kennedy Memorial Center.

Blogging ACTA Across The Globe: FFII's Ante Wessels on Exporting Europe's Flaws

,----[ Quote ]
| Every major country in the ACTA
| negotiations claims that its own laws will
| remain unchanged by the treaty. But without
| changing a word of domestic law, ACTA can
| still be dangerous to a country's â or a
| continent's â economy. This week at
| Deeplinks, we've asked guest bloggers from
| around the world to give their perspective
| on the trade agreement. Today, giving the
| view from the heart of the European Union,
| is Ante Wessels, analyst for the Foundation
| for a Free Information Infrastructure, a
| group best known for their work in Europe's
| debate over software patents.

ACTA Guide, Part Five: Speaking Out

,----[ Quote ]
| The 7th round of ACTA negotiations will
| conclude around lunch time today in Mexico.
| If past meetings are any indication, a few
| hours later the participating countries
| will issue a bland statement thanking the
| host Mexican government, discussing the
| progress on civil enforcement, border
| measures, and the Internet as well as
| noting the transparency discussions and the
| continued desire to address the issue. The
| release will then conclude by looking
| forward to the next meeting in Wellington,
| New Zealand in April.

ACTA Attacks Internet! Let's Attack ACTA!

,----[ Quote ]
| Negotiations on the Anti-Counterfeiting
| Trade Agreement (ACTA)1 will take place
| from January 26th to January 29th in
| Mexico. ACTA aims at controlling the
| Internet, while conveniently circumventing
| democratic processes. Unelected negotiators
| - carrying out the orders of the
| entertainment industries - are attacking
| the very essence of the Internet. Let's
| attack ACTA! Let's expose its negotiators
| to make them face their responsibilities!

ACTA and three strikes

,----[ Quote ]
| Luc Devigne for instance advocates for the
| French âthree strikesâ rule concerning
| ISPs. Such measures are not yet part of the
| acquis communautaire, in fact in the course
| of the Telecom package such measures were
| generally rejected, though the European
| Parliament could not overrule the French
| national decision to implement such
| measures (âHadopiâ). Sarkozyâs Hadopi rules
| are in troublesome constitutional waters,
| we will see.

Early Day Motion Calling for ACTA Transparency

,----[ Quote ]
| Yesterday I was asking you to write to your
| MPs about the Digital Economy Bill. If you
| haven't already done that, perhaps you
| could tack on a request for them to support
| this Early Day Motion...

ACTA Guide, Part Three: Transparency and ACTA Secrecy

,----[ Quote ]
| Part Three of the ACTA Guide (Part One on
| the agreement itself, Part Two on the
| official and leaked documents) focuses on
| the issue that has dogged the proposed
| agreement since it was first announced -
| the lack of transparency associated with
| the text and the talks. As yesterday's
| public letter from NDP MP Charlie Angus and
| the UK cross-party motion highlight,
| elected officials around the world have
| latched onto the transparency issue and
| demanded that their governments open ACTA
| to public scrutiny. Reviewing the ACTA
| transparency issue involves several
| elements: the public concern with ACTA
| secrecy, the source of the secrecy, and the
| analysis of whether ACTA secrecy is common
| when compared to other intellectual
| property agreements.

PROPOSED INTERNATIONAL ANTI-COUNTERFEITING TRADE AGREEMENT

,----[ Quote ]
| That this House is deeply concerned by the
| secrecy surrounding international
| negotiations on the Anti-Counterfeiting
| Trade Agreement (ACTA); notes that any
| agreement reached could affect the measures
| to protect copyright online currently being
| debated in the Digital Economy Bill;
| believes that if the companies affected by
| the agreement are party to the discussions
| and able to influence decisions,
| parliamentarians who represent the public
| and are responsible for legislation in
| these areas should also be kept up-to-date
| with developments and be able to contribute
| to the debate; seeks assurances from the
| Department for Business, Innovation and
| Skills that the provisions of the Digital
| Economy Bill will not be superseded by
| ACTA; and urges the Government to work to
| achieve release of details of the
| negotiations to hon. Members as soon as
| possible.

CTA: The new era of transparency

,----[ Quote ]
| How is that possible? It cannot be found out
| because the mandate is not made public. Magic,
| it reminds me of the charlatans who say they
| live without food and water supply, and it is
| their personal secret what makes them survive.

Activist ejected from "public" meeting on secret copyright treaty for tweeting

,----[ Quote ]
| The latest round of negotiations over the Anti
| Counterfeiting Trade Agreement (ACTA -- a
| secret treaty that contains provisions
| requiring nations to wiretap the Internet,
| force ISPs to spy on users, search laptops at
| the border, and disconnect whole households
| from the net on the basis of mere accusation
| of copyright infringement) is just kicking off
| in Mexico, and activists from around Mexico
| and the world have converged on the meeting to
| demand transparent, public negotiations of
| this critical treaty.

'Public' Consultation Over ACTA In Mexico Almost Required NDAs, Blogger Removed For Tweeting

,----[ Quote ]
| The room, then, was mostly industry people,
| who were apparently concerned as to why
| everyday citizens were in attendance, and they
| even booed a lawyer who questioned the human
| rights angle. As for Geraldine, she tried
| twittering the event, and the industry folks
| demanded she leave (and had a guard escort her
| out). It's almost like they're trying to make
| themselves into a caricature of businesses
| plotting to harm the public.

Joe Biden promises a blank check to the entertainment cartel

,----[ Quote ]
| VP Joe Biden stood up in front of a bunch of Hollywood execs and promised to
| appoint a copyright czar, and furthermore, that this would be the "right"
| person to protect their interests. I would have voted Dem in the last
| election, if I got a vote, but make no mistakes: the Dems are the party of
| stupid copyright laws.
