Monsantoâs Seed Patents May Trump Antitrust Claims (Update2)

,----[ Quote ]
| âJustice is clearly trying every way it can
| to see whether Monsanto is exceeding its
| rights under the patent,â said James Weiss, a
| Washington-based attorney at K&L Gates LLP
| who helped defend Microsoft Corp. against a
| federal antitrust probe. âAt the end of the
| day, they may not be able to do much with it
| because of the scope of those patents. In
| almost all the cases, the courts come out on
| the side of intellectual property.â
|
| Yet Monsantoâs seeds are so ubiquitous that
| they have become like AT&Tâs telephone lines
| before the companyâs 1984 breakup or
| Microsoft Corp.âs Windows operating system in
| the 1990s, said James P. Denvir, an attorney
| who represents rival seedmaker DuPont Co. and
| led the governmentâs AT&T case.

|
| Monsantoâs attorney, Dan Webb, defended
| Microsoft in 2002 against government
| antitrust claims. A former U.S. Attorney in
| Chicago, he also prosecuted Admiral John
| Poindexter in the Iran- Contra affair.

BSA Settles Lawsuit Against Nevada-Based Engineering Company for $205,000

,----[ Quote ]
| The Business Software Alliance (BSA) today announced that Taney Engineering,
| Inc. and Taney Cunningham Equipment, LLC of Henderson, Nevada, a joint civil
| engineering and land survey services company, settled a lawsuit filed in the
| United States District Court for the Northern District of California (Docket
| #C08-03132) alleging copyright infringement. BSA initially contacted the
| companies through its out-of-court audit program. When that proved
| unsuccessful, a lawsuit seeking an injunction to stop the defendants from
| making or distributing unauthorized copies of Autodesk software as well as an
| unspecified amount of damages and attorneys' fees in connection with the
| litigation, was filed on behalf of Autodesk, Inc., a BSA member company. The
| suit was filed on June 30, 2008 and settled in December.

Open Source Piracy: Uncle BSA, Open Source wants you!

,----[ Quote ]
| Piracy, the marketing name chosen by the Business Software Alliance to
| describe copyright infringement, is defined by the BSA as follows:
|
| Software piracy is the unauthorized copying or distribution of
| copyrighted software. This can be done by copying, downloading, sharing,
| selling, or installing multiple copies onto personal or work computers.
| What a lot of people donât realize or donât think about is that when you
| purchase software, you are actually purchasing a license to use it, not
| the actual software. That license is what tells you how many times you
| can install the software, so itâs important to read it. If you make more
| copies of the software than the license permits, you are pirating.
|
| Reading the piracy definition I understood that Open Source Piracy actually
| really hurts open source. Donât get me wrong, you can hardly make more copies
| than the allowed number with open source, of course. Still you might
| distribute copyrighted open source software irrespectful of the license.
