Um, interesting take on the position.  I would say, also, though that
the potential linux customer base is also a loser, as they are most
certainly affected by the legal fud.  I've had many internal discussions
with our legal folk in this area, much of which have been driven by
misapprehension of risk directly driven by this kind of fud.
Fortunately, however, things seem to be improving;  the last legal chap
I had a discussion with was an ex-systems guy who'd retrained as a
lawyer, so understands the GPL both from a software and a legal
perspective.
