They are claiming "open source", not "Open Source", so the OSI has no
say in the matter. The term "open source" was in use in the free
software community long before the date OSI claims they invented it.
Google on
"open source" free software
in groups with a date restriction of before 1998-02-03 (the date OSI
claims to have "invented" it). Caldera, for example, was using the term
"open source" to describe their Linux distribution as early as 1996.
