[News] SCO Might Die Very Soon After All

Insolvent SCO scraps its reorganization plan

,----[ Quote ]
| SCO Group Inc., the Utah County-based bankrupt software developer that claims
| to own copyrights to the Unix operating system, has scrapped a $100 million
| reorganization plan after its financial sponsor asked for a new deal.
|
| [...]
|
| The U.S. Trustee monitoring SCO's case for the Justice Department may demand
| that the company be taken over by an independent fiduciary if the talks with
| Stephen Norris fail to deliver a reorganization plan. This is the company's
| third attempt to negotiate a way out of bankruptcy, Joseph McMahon Jr., an
| attorney with the U.S. Trustee's office, told Gross.
|
| "I don't think this case can take a fourth chapter," McMahon said.

SCO 10Q: the MOU with Norris Ain't Carved in Stone, Y'all

| Woe is me. There might be no appeal? No more SCO? Everything depends on money
| in a reorg? Plus figuring out how to actually make a profit going forward?
|
| How do you like this news, about more downsizing ahead...
|
| Now if only someone would loan SCO some eggs, at 20% interest, SCO could
| serve up some dancing baloney and eggs.

Novell steering clear of SCO Group buyout, attorney says

,----[ Quote ]
| Novell Inc. has had no contact with the head of a company trying to buy the
| bankrupt SCO Group and plans to go ahead with a trial next month to determine
| how much SCO may owe it for licensing the Unix operating system, officials
| said Monday.

Did Microsoft ruin SCO?

,----[ Quote ]
| Which comes to the scenario in mind. Gates approaches McBride and puts forth
| a proposition that SCO should try and make money out of Linux. He offers to
| bankroll the operation in a backhanded manner and then steps back to watch
| the action unfold. His reasoning for doing this? To have a test run before he
| puts Microsoft through the same paces. Either way he wins.

SCO Plans Rebound Thanks to $100M Lifeline

,----[ Quote ]
| Embattled Unix vendor SCO may get a new lease on life, thanks to a $100
| million infusion aimed at helping it emerge from bankruptcy and pursue its
| controversial legal claims.
|
| The financing comes from Stephen Norris Capital Partners (SNCP), which will
| take a controlling interest in SCO as part of the deal.

SCO acquisition wrap-up

,----[ Quote ]
| Datamation's Roy Schestowitz notes that for a company with such a troubled
| and checkered past, it's a mystery why anyone would want to come forward and
| help rescue it from certain death. "Why would anyone invest in SCO?" he
| asks. "More importantly, why now?"
|
| Groklaw's Jones may have an answer. She suggests a connection between the new
| investors and Microsoft's Bill Gates.
|
| In the end, though, all the hype may be just that -- hype. Jim Zemlin,
| executive director of The Linux Foundation, says all the theories and
| conjecture are just navel-gazing. In fact, he says the whole story is nothing
| more than "a speculator picking the bones of a defunct company. The facts of
| the SCO case haven't changed; the Linux industry is stronger than ever."

SCO announces reorganization plan - $100 M from SNCP & "partners from the
Middle East", to go private - Updated

,----[ Quote ]
| Update: It seems Bill Gates has a friend in this picture. The two announced
| another deal last year, according to this IHT article, "Four Seasons Hotels
| agrees to bid from Gates and Alwaleed":
|
|     Gates and Alwaleed have collaborated for at least two years. After
|     attending a dinner at Gates's home in Bellevue, Washington, in early
|     2004, Alwaleed agreed to explore ways to assist Microsoft's expansion in
|     Saudi Arabia.

SCO: taken over, slightly richer, but still on its way out

,----[ Quote ]
| Ovum has been dismissive of SCO's legal claims ever since the company first
| aired them. This latest twist does not change our mind, on the contrary. Like
| many others, we are puzzled by SNCP's decision; puzzled but not completely
| surprised. After all SCO had been desperately trying to find a new financial
| backer ever since the August 2007 legal setback against Novell which affirmed
| Novell's, rather than SCO's, ownership of the Unix copyrights. This setback
| caused SCO to file for bankruptcy in September 2007 and to announce a plan to
| sell its Unix assets to JGD Management Corp/York Capital Management LLC for
| up to $36m a month later. The plan failed. It has now found a Plan B with
| SCNP.

Quick Take: An Insane Investment in SCO

,----[ Quote ]
| Assuming that the legal system hasn't gone entirely bonkers yet, the
| investment also sets Red Hat  (NYSE: RHT) up to follow its lawsuit against
| SCO to its logical conclusion, after the IBM suit fizzles out. If I were Red
| Hat, I'd send Stephen Norris a thank-you note. Seriously, guys -- what were
| you thinking?

| There you have it. At least a third of SCO's entire market
| capitalization, and their entire current cash reserves, is payoffs
| funnelled from Microsoft. Their 10Qs reveal that every other line of
| cash inflow is statistical noise by comparison. The brave new
| SCO source business model is now clear: sue your customers, shill
| for Microsoft, kite your stock, and pray you stay out of jail.
