I find this bit most interesting and worth watching:

So if you develop some software all by yourself and MS (or anyone else?)
finds it encroaches one of their patents, are they going to be satisified
with that defence by you?
Even more pertinent, doesn't it try to go as far as to nullify software
patents (particularly in this case, but potentially as caselaw?), or
possibly all patents? - Just claim developed the idea all by yourself.
Will the patent holder have to prove you used their patent [ideas] when you
claim you did it all by yourself?
