Grokking SCO's demise

,----[ Quote ]
| It's Groklaw's loose network of volunteers that has haunted the Utah
| courthouse, collecting paperwork, reporting on hearings and transcribing
| everything in sight.
|
| It's that same crowd of volunteers that has picked apart arguments, dredged
| up old news stories and computer manuals, and generally followed the SCO
| lawsuits with the kind of enthusiasm usually reserved for rotisserie baseball
| or, well, Linux.
|
| All that has made it easy for reporters, analysts and deep-thinkers keeping
| an eye on the lawsuits. We just filtered out the partisan crowd noise -- no
| mistake, this is a pro-Linux crowd -- and dug into that virtual mountain of
| legal documents. Everything was there, posted, transcribed, organized and
| searchable.
|
| That's why we all picked up the ruling from Groklaw.

Another good example of women in Free software.

Harald Welte and Groklaw announced as winners of the FSF's annual free software
awards

,----[ Quote ]
| Groklaw's founder and editor Pamela Jones could not make it to the ceremony
| in person, but Groklaw contributor Dan Bricklin was present to accept on her
| behalf. In a prerecorded audio message, Jones described Groklaw as "a place
| where lawyers and geeks could explain things to each other and work together,
| so they'd understand each other's work better". Jones also emphasized the
| importance of Groklaw's free software approach to its success, "[W]hen you
| have an idea you hope might work, and then to implement it, tweak it, and
| morph it, because other people show up and have ideas that are better than
| yours...and then have people you care about and admire tell you that what you
| are doing matters -- I can't think of a more satisfying feeling."

Yet More Filings in Novell - Why SCO Wants No Mention of IBM or Groklaw -
Updated

,----[ Quote ]
| Groklaw is hazardous, because all his statements are here, and of course most
| of them were made in the context of filing its litigation against IBM. The
| SEC filings are here on our SCO Financials page. The teleconferences are here
| on our Transcripts page. There's just no telling what a juror might stumble
| across. Like, say, in our Quote Database, where all the wild and now provably
| untrue statements McBride made about owning System V copyrights that SCO said
| it got under the 1995 APA are preserved for history. Oh, and all the
| statements about Novell and how it had no right to say it owned the
| copyrights. My, my. I agree. Groklaw is juror quicksand for SCO. If I were
| SCO I would be worried that the same thing will happen in court that happened
| in the court of public opinion. What I don't understand, unless this was
| intended as FUD lawsuit, is why the SCO legal team let the SCO executives say
| so much to the media in the first place.

Groklaw: The Industry's Eyes in Court

,----[ Quote ]
| Did Groklaw really have an impact on those court cases? Naaah. The impact was
| on the rest of us. That collection of documents gave SCO's suits a
| transparency that's impossible to come by with most IT industry litigation.

SCO Tried to Gag Groklaw in 2004

,----[ Quote ]
| So SCO tried to gag Groklaw beginning in 2004. It moved on to
| false insinuations to journalists, ugly innuendo during a conference
| about me and Groklaw, having friendly journalists with PIs try to
| dig up dirt on me, a massive astroturfing campaign all over the
| internet, and then finally to intimidation with their recent motion.
| Well, I'm gagging, all right, but not in a good way, and certainly
| not in the way SCO hoped.
|
| I will respond like this, seriously for a moment. This is America.
| I am an American citizen. I was born here, born to certain rights
| as my birthright. I'm allowed to cover this litigation without
| being harassed and intimidated or threatened or gagged. I'm
| allowed to present facts that disprove SCO's public allegations.
| I am allowed to write what I believe is the truth, and I'm
| to present research about the allegations.

SCO CEO McBride Speaks Out On Novell, Finances, And Groklaw

,----[ Quote ]
| InformationWeek: The Web site Groklaw has given you a pretty rough time over
| the past few years. What effect has that had on your image?
|
| McBride: I don't think you can discount the impact of Groklaw in trying to
| create a bad image around us. It's the equivalent of a negative political ad
| campaign. We used to counter everything Groklaw said. I thought it was my
| responsibility to SCO stakeholders to have a counter reaction to all these
| attacks. It turns out that doesn't work well in a courtroom setting. The
| judges told us that, my attorneys told me that, so I decided to back off.
|
| We just want to have a day in court. Though early on I admit to being more
| engaged in the battle.

If this is true SCO’s execs are in BIG trouble [Groklaw confirmed it's true.]

,----[ Quote ]
| SCO made a lot of claims during those press conferences, some of which never
| made it to court and were quickly glossed over. At times it seemed like the
| company was saying whatever it could while it had the chance. It’s no
| coincidence that the public claims stopped once the legal nitty-gritty got
| started.

SCO Could Face Cash Crunch After Novell Trial

,----[ Quote ]
| The amount that SCO owes to Novell is now the primary focus of the case as it
| moves toward a trial that's slated to start on Sept. 17. SCO's problem: It's
| potentially on the hook for a sum that exceeds its total cash and assets.

SCO Goes Bust in the Courtroom

,----[ Quote ]
| SCO essentially attempted a costly, time-consuming "Hail Mary" to score a big
| payday. It might have better spent that time building products and getting
| customers. What's more, it picked fights with big-name tech players who know
| how to wage a court battle.
|
| As of now, SCO's shares are trading at $0.51 apiece, and the company sports a
| market cap of a measly $11.5 million. It's definitely a sobering example.
| Foolish inventors looking at companies with similar strategies should realize
| that they're more like lotteries than businesses.
