More about the App Store GPL Enforcement

,----[ Quote ]
| Since our announcement yesterday that we
| were pursuing a compliance case involving
| GNU Go in Apple's App Store, we've received
| a lot of questions about the details of the
| conflict between the GPL and Apple's terms
| of service. For those of you who are
| interested, we're providing those details
| here.
|
| Let's start by making sure everybody's on
| the same page: in order to use the App
| Store, you have to agree to the iTunes
| Store Terms of Service and/or the App Store
| Terms of Service. You can confirm this
| yourself just by reading the documents:
| they say as much in their all-caps
| preambles. The two documents are pretty
| similar; this post will give section
| numbers from the App Store Terms of
| Service, but the same language appears in
| the iTunes Store Terms of Service and so
| our analysis applies identically to it. You
| can read both those documents on Apple's
| site, and we have a copy of that page as it
| exists today to provide this commentary.

Apple's base strategy deployed against FSF

,----[ Quote ]
| Apple these days has a base strategy.
|
| Killing an app because it has a GPL license
| and your store policies conflict with the
| GPL is a base strategy. The Free Software
| Foundation made a political complaint.
| Apple acted in the way of a base politician
| â if the other side hates it then it must
| be good.

FSF Elaborates on App Store Enforcement

,----[ Quote ]
| It is disappointing that Apple took this
| route. The company could accommodate
| copylefted software, but chooses not to.
| The question is whether Apple's disdain for
| openness is going to cost it any
| significant business.

Report: DOJ inquiry of Apple goes beyond music

,----[ Quote ]
| Investigators with the Department of
| Justice have begun asking questions of
| executives in the film industry and other
| media sectors, according to a story that
| appeared Friday in The New York Post.
|
| "The [Justice Dept.] is doing outreach," an
| anonymous Hollywood source told the Post.
| "You can't dictate terms to the industry.
| The Adobe thing is just inviting the wrath
| of everybody."

Apple probe grows

,----[ Quote ]
| The Justice Dept.'s probe into Apple is
| expanding to include how the iPhone and
| iPad maker does business with media outfits
| in areas beyond music, The Post has
| learned.
|
| According to several sources, the Justice
| Dept. has contacted a handful of the
| country's biggest media and technology
| companies to get their views on Apple,
| which, after years of casting itself as the
| tiny outsider, has become an 800-pound
| gorilla calling the shots in several
| arenas.
|
| "The [Justice Dept.] is doing outreach,"
| said one Hollywood industry source. "You
| can't dictate terms to the industry. The
| Adobe thing is just inviting the wrath of
| everybody."

FSF take on Apple's App Store over GPL2 code

,----[ Quote ]
| The Free Software Foundation has said it has
| approached Apple because a GPL2 licensed
| application, a port of GNU Go, is available
| from Apple's App Store. The FSF say that
| distribution through the App Store is not in
| compliance with the GPL's conditions because
| they clash with Apple's terms and conditions.
| The developers of the application, are also
| not in compliance with the GPL as they do not
| currently distribute the source for the
| application. Brett Smith, writing on the FSF
| blog, is at pains to say that the FSF have not
| sued Apple or made any legal demand and says
| the only reason they are announcing this is
| because Apple has removed applications from
| the store before without explanation and that
| they want to prevent wild speculation.

Fanboi's lament â falling out of love with the iPad

,----[ Quote ]
| As the iPad goes on sale in the UK (and
| eight other countries), I've had my own
| "magical and revolutionary" Apple tablet
| for exactly 56 days. And I'm using it less
| and less each day.
|
| My fading relationship with my iPad reminds
| me of a long-ago college fling with a young
| lovely. High anticipation, fervent
| consummation, growing familiarization,
| decreasing fascination, and the inevitable:
| "No, hon, it's not you. It's me."

Mozilla sidesteps iPhone code ban with Firefox Home

,----[ Quote ]
| Mozilla won't submit a Firefox browser to
| Apple's iPhone App Store. It has no
| intention of taking its browser where "it's
| not wanted." But the open source outfit is
| developing an iPhone incarnation of Firefox
| Sync, the browser bookmark-syncing service
| formerly known as Weave.

DOJ inquires about Apple's hold on digital music

,----[ Quote ]
| The U.S. Department of Justice has begun asking
| questions about Apple's role in the recent
| scaling back of special music discounts and
| promotions at Amazon, according to two high
| level music industry sources.

GPL Enforcement in Apple's App Store

,----[ Quote ]
| An iPhone port of GNU Go is currently
| being distributed through Apple's App
| Store. However, this distribution is not
| in compliance with the GNU GPL. The
| primary problem is that Apple imposes
| numerous legal restrictions on use and
| distribution of GNU Go through the iTunes
| Store Terms of Service, which is forbidden
| by section 6 of GPLv2. So today we have
| written to Apple and asked them to come
| into compliance. We would be happy to see
| Apple distribute these programs under the
| GPL's terms, but unfortunately, it seems
| much more likely that they'll simply make
| the problem go away by removing GNU Go
| from the App Store.
