That mutal covenant has done the exact opposite: if there is no Microsoft
Patents in Linux, why have a covenant not to sue? For what is there for MS
about which it can sue? The only reasonable conclusion that can come from
the mutual covenants is that there [more than likely] /IS/ MS IP in Linux.
In which case, the community would love to know about it so that something
could be done about its removal - clearly something MS doesn't want and so
must damage their damages claim.
